An in depth explanation starting with the history of copyright which started in England in the late fifteenth century. It explains how as printing presses began to grow, authorities sought to control the publication of books by granting printers a near monopoly on publishing in England. So the Licensing Act of 1662 confirmed that monopoly and established a register of licensed books to be administered by the Stationers’ Company, a group of printers with the authority to censor publications. This book follows the different cases that happened as a result of the different laws that began to emerge following the Licensing Act of 1662. The information is explained through the viewpoints of the author himself. He follows the different and most current legislations that exist under the topic of copyright and explains how each one of them works and how it affects the user. He follows it up with an in depth explanation of his prediction of the future of copyright laws and how it'll affect the future generations.

Besek explains how the collecting and preserving of digital content poses challenges to the intellectual property rights that libraries and archives are use to following. A balance between copyright owners and users is an ongoing process; therefore, Besek offers a paper in which she describes the copyright rules and exceptions. She also focuses on issues those involved with libraries and archives might encounter if involved in the creation of a digital archive. Besek explains that numerous factors exist when determining the copyright implications for works being considered for inclusion in an archive. Some of these factors include: the purpose of the archive, its subject matter, the manner in which it will acquire materials, and who will have access to the archive, and from where, and under what conditions. The purpose of Besek’s paper is not to go in-depth about copyright, but to provide the reader and potential archive creator, with information about basic copyright matters, so that the creator might recognize areas of concern as he/she plans the archive.

This report discusses what archives must do in order to provide access to unpublished sound recordings from 1972 and earlier. Unpublished sound recordings may have been created for private use or broadcast, but were not distributed to the public. They may have been such recordings as live musical performances or interviews. Unpublished sound recordings rights are different from commercial recordings intended for sale. Archives and libraries may have purchased them or have had them donated. Some may be significant because they may be the only recordings of a particular event. The report’s review of copyright law finds that libraries are liable for preserving, copying, and streaming unpublished sound recordings from pre-1972. However, it finds it unlikely that libraries will ever be held liable for these laws, especially since sound recordings and their legal protection vary so much.

This paper describes the expansion of web archiving in Singapore and its affiliation with international copyright law. The authors outline the concept of legal deposit in a modern and historical context. In addition, the authors contrast voluntary and compulsory legal deposit, and the ways the National Library of Singapore apply those important concepts. Two main projects are detailed: Web Archive Singapore and the Singapore Memory Project. The paper conducts an analysis of the implementation of legal deposit for the preservation of materials located on the World Wide Web. The electronic material invokes a complicated relationship between copyright and the need to preserve digital information, and describes obstacles which litter the information lifecycle of web archiving. In the latter portion of the paper, a set of conclusions and recommendations regarding the need for reviewing copyright law to promote academic research within Singapore.

Andrew Charlesworth, senior research fellow in IT at the University of Bristol, reports on copyright permissions and legislation affecting the archiving of Internet sources in the UK, Europe, Australia, and the United States. In this report, Charlesworth identifies the national legal and technical responses for protecting intellectual property, and describes countermeasures taken by libraries and archives to obtain and open access to these Internet sources.
While Charlesworth notes that the U.S. system is both "pragmatic and confusing," he illuminates key issues for U.S. digital archivists and librarians including laws favoring primarily "physical" and "decisional" privacy rights. This translates into government protection mainly for individuals and not for third parties, such as libraries and archives. The principles of fair use and rights to create archival copies do not necessarily afford a web archive's right to preserve and disseminate web content. Charlesworth cites two major U.S. web archiving projects, the Library of Congress' "Minerva" and the Internet Archive. Although Minerva served primarily to gauge user response to a limited number of archived web sites, the Internet Archive continues to expand as it adheres to its mission to preserve all "publicly accessible materials displayed on the Internet." Charlesworth contrasts the lack of selection policy and surface web crawling against European and Australian more clearly defined guidelines and licensing options. The U.S. web archiving practices, indicated by Minerva and the Internet Archive, do not have clearly defined legal permissions and are thus vulnerable to legal redress as well as losing potentially valuable information in the "deep" (private) web.

Although the article is written for a British audience and the copyright laws and legislation regarding author/creator’s “moral rights” are different from the U.S. similar challenges from special interest groups and handling orphan works beset American archivists as they do British archivists. The author also recommends policies appropriate and practical for digital archivists in the U.S. Encouraging the creator to establish access and property rights before ingesting the materials and assisting the depositor with creating metadata are strategies that may enhance access without violating copyright infringement. Other strategies include risk management planning and carefully assessing the varieties of licensing required of each type of deposited object. Establishing “clear and ethical guidelines” for accessing or reusing the collection and incorporating descriptive, structural, and administrative metadata (legal references) should ameliorate risks of copyright and intellectual property infringement.

Chris Needham opens the door on the common copyfraud that occurs when museums misrepresent or restrict rights in a way that go against public domain copyright law. Needham first explains relevant copyright issues such as the copyright of certain artworks and books. Copyright lasts for about seventy years, but certain copyright laws can be a gray area when it comes to preservation of artifacts. How these artifacts become part of the public domain is a photograph is taken of the artifact and posted online for anyone to see much like a virtual museum. The author then dives into how the copyfraud of archives affect universities, publishing houses, and museums. In a more positive light, Needham shows how librarians and visual resource managers are supporting museums change their approach to copyright and copyfraud. Needham focuses on how this change is transforming scholarship and allowing scholars and librarians to better serve the public.
Chris Needham’s article is a well-written piece that dives into the issues that archives face with copyright laws. While copyright laws have been around for a long time, it can be difficult to interpret those laws for very specific situations, and it can be easy to commit copyfraud without realizing. This article is eye-opening and an important read for anyone within the scholarship field.

This is a presentation by Covey to Carnegie Mellon University. She writes that in order to make a digital copy, one must have considered digital preservation and copyright law. If something is out of copyright, it can be copied. If the owner of the copyright or the law permits it, it can be copied. Any other copying infringes on copyright. Preservation of digital copies entails best practices in scanning, storage of master files, backup copies in multiple locations, and consideration of format changes. When using copyright protected material by permission, the publisher and source must be stated, as well as the fact that work is the author's version. Covey calls for civil disobedience and moral courage as she hopes to provide open access to university materials, including dissertations and lectures. However, she says that few have contributed due to a lack of awareness, reward, and time from faculty, as well as negative attitudes of peers. She also feels that people’s misconceptions about copyright are to blame. Many faculty members do not understand copyright and they do not want to lose control of their own work.
